By continuing to use the Site after having an opportunity to review this Privacy Policy, you have accepted the Privacy Policy in its entirety and without modification and consented to our collection, use and sharing of your information, as described in this Privacy Policy. If you do not agree with this Privacy Policy, please exit and do not use the Site. We may revise this Privacy Policy periodically and will post any changes to the Site. Changes to this Privacy Policy are effective at the time they are posted and your continued use of our Site after posting will constitute acceptance of those changes. 1. Information We Collect. The personal information we collect depends on how you interact with us and may include the following:
  • Device Information: When you visit our Site or open our emails, we may learn information about your browser (name, version, settings, etc.), device type and settings, IP address, MAC address, unique device or other online identifier, internet service provider, the name and version of your operating system, referring and exit pages, the date and time of your visit, blockchain public key address, wallet type, and other similar details.
  • Website and Email Interactions: We may collect information about your interactions with our Site, including the pages you visit, links or buttons you click, the search terms you enter, and other similar interactions with the Site. We may also collect information about your interactions with our email correspondence (e.g., whether you’ve opened the email, the links or buttons you click within an email, etc.).
  • Location Data: We may use various technologies to learn your approximate geographic location, including by collecting your IP address or other device information, which may depend on your device or browser’s settings for location services.
  • Contact Information: We will collect your contact information, including first and last name, address, telephone number, and email address, if you provide it to us.
  • Payment Information and Payment Details: We will collect your financial account information or other payment details (including, for example, information about your digital wallet) if you reserve a non-fungible token ("NFT") or make a purchase on the Site or if you add such payment information to your Xylocats account.
  • Transactional Data: We keep track of your purchase history with us, including the NFTs you reserve, purchase, resell, "like" or save to your account, or add to your online shopping cart.
  • Account Credentials: If you register an account with Xylocats, we will collect your account credentials, including your account username or login and password.
  • Call, text, and email records: If you call, text, or email with Xylocats or our customer service agents, we may keep records of those conversations including all such information you have provided to us in connection with such conversation.
  • Submitted Content: We will collect any content you submit to our Site, including photos, videos, feedback about the Site, or reviews of our products.
  • Demographic Information: We may collect demographic details about our users and customers such as age, gender, regional location and ZIP code, among other similar details.
  • Preferences: We may collect information about your preferences, such as your email preferences, how you prefer content to be displayed on the Site, and products you may be interested in.
  • Inferences: We may draw inferences about any of the above information that reflect your preferences, characteristics, or other matters.
2. How Your Information is Collected. We collect the information described above directly from you, from third parties we partner with, and through cookies or other automated means.
  • Directly from You: We collect information directly from you whenever you make a purchase, contact us with questions or comments, enter our contests, sweepstakes, or other promotions; respond to a survey, submit a product review; opt in to receive text messages from Xylocats, fill out any forms on our Site, or otherwise contact us or submit content to our Site.
  • From Third Parties: We partner with third parties who provide services to us, like analytics or advertising companies, email and text message service providers, companies that assist with website functionalities (including, for example, third-party wallet providers and our payment processing service providers), etc. These third-party partners may collect information about you via the Site, and may share the information they have collected with us.
  • Automatically via Your Device or Browser: Certain information is automatically collected from your device or browser and analyzed when you visit our Site or open our emails.
  • Automatically via Cookies: Xylocats uses cookies (small files stored on your device or browser), pixel tags (tiny graphic images embedded in a website or email), and other similar technologies to automatically collect information when you visit our Site or interact with our emails. Through the use of cookies and similar technologies, we may link information about your interactions with our Site or emails over time, for example, which pages you visit, which links you use, and how long you stay on each page.

    We may also contract with third-party companies, including, for example, marketing or analytics companies, such as Google Analytics, who also use cookies, pixels, or similar technologies to collect device information and information about your interactions with our Site. We receive aggregate information from these third parties to understand our advertising effectiveness and to understand the operation, functionality, and use of the Site. The collection and use of your information by Google Analytics is governed by Google’s privacy policy.

    Some of the cookies we or our partners use on our Site are necessary for the operation of the Site; others are not.
  • Publicly Available Data: We may collect information about you from publicly available sources, including information available publicly on blockchains, such as your blockchain address and information regarding your purchases, sales, or transfers of NFTs.
3. How We Use Your Information. We use the information we collect for the following purposes:
  • To Provide our Site and Services: To allow you to view and browse our selection of Ancient Space Cat NFTs, and otherwise navigate our Site and use our services.
  • Fulfillment: To fulfill your purchase orders, NFT-reservation requests, and other requests, including by processing your payments, confirming or updating you on the status of your reservation or purchase, and delivering products to you.
  • Communications: To communicate with you, including to respond to your requests and inquiries, to ask for feedback through surveys, product reviews or other messages, and by sending you newsletters, promotional materials, and other notifications regarding the Site and our products and services (e.g., to notify you of events or changes affecting NFTs or other products you’ve saved or "liked" within your Xylocats account).
  • Understanding Our Customers: To help us analyze our Site and our userbase (including your interactions with our Site and emails, analyzing trends and statistics, etc.). We keep track of the pages you and other Site users visit and the manner in which you and other Site users use the Site to determine, for example, which NFTs or products are most popular, whether to make changes to the Site, whether and how to develop new products and services, and to help us analyze trends, patterns, and preferences.
  • Marketing and Advertising: To present advertising online and via email and other communication channels, including through partnerships with social media platforms and internet search engines, and to measure the reach and effectiveness of those advertisements.
  • Personalization: To personalize your browsing experience by using your product interests and browsing patterns to recommend other products, services, or promotions that we believe you may be interested in, and to personalize our digital advertisements.
  • Promotions: To facilitate contests, sweepstakes, or other promotions.
  • Site Maintenance: To provide, maintain, or troubleshoot access to our Site (including Xylocats accounts) and to monitor, evaluate, and improve the content, functionality and usability of our Site (e.g., debugging, measuring website traffic, etc.).
  • Security: To protect Xylocats and our customers from fraud, security threats, and other illegal or harmful activity (e.g., we may use your email address or phone number to verify your identity in the event you need to recover your Xylocats account). We and our third-party service providers may disclose specific individual information if we or they reasonably believe it is necessary to: (i) investigate any suspected misuse of the Site; (ii) protect or defend the rights, property and interests of Xylocats, our customers, or the interests of our third-party service providers; or (iii) under exigent circumstances, to protect the personal safety of users of the Site or the public.
  • Legal Obligations: To comply with legal and regulatory requirements and responding to requests from courts or other government bodies.
4. How We Share Information with Service Providers and Third Parties and For What Purposes. We may share information with third parties for certain purposes, as set out below.
  • Service Providers and Partners: As noted above, we partner with third parties that assist with many aspects of our business, including advertising and marketing, analyzing the interest in and activities on our Site, operating and providing certain functionalities for our Site, and helping us communicate with our customers. These third parties may provide services related to any of the purposes described in section 3 "How We Use Your Information," and we may share with them any types of information described in section 1 "Information We Collect."
  • Digital Wallets: When you make a purchase on the Site using your digital wallet, we will share information with your digital wallet provider in order to effectuate the transaction.
  • Xylocats Affiliates: We may share information we’ve collected via the Site with our Xylocats affiliates.
  • Parties to a Business Transaction: Your information may be transferred to another entity that succeeds to all or part of our business in connection with a sale, reorganization, consolidation, or merger. Your information may be shared under obligations of confidentiality and non-disclosure to a prospective successor or purchaser of our business.
  • Other Third Parties: We will disclose information about you, including to government bodies or law enforcement agencies, when we believe it to be necessary for compliance with the law or to protect our Site users, our Site, or the public.
  • Information Made Public: Part of the nature of public blockchain technology is that certain information associated with a transaction effectuated on the blockchain is intended to be publicly available. This is true with respect to Ancient Space Cat NFT transactions.
5. Your Privacy Choices. You can control the information we collect and use personal information in the following ways:
  • Location Data: You can disable location-based services on your mobile device or web browser by adjusting the settings on your device or browser. This will prevent our Site from accessing your location information. Note that some services may not be available if you disable location-based services, and you may experience difficulties making a purchase using the Site.
  • Cookies: You can configure your browser so that it will not accept third-party cookies by following your browser’s instructions. If you do not permit your browser to accept cookies, you may experience some inconvenience in your use of the Site. Cookies are required to make use of login and account features on the Site.
  • User Requests: You can contact us at any time using the contact information in section 12 below to request we do any of the following: (i) change, update, or correct your personal information; (ii) access your personal information and, where applicable and feasible, request to receive that personal information in a commonly used electronic format (or ask for this information to be provided in that format to a third party); or (iii) disclose what personal information we collect, use, or disclose. You may also request that we stop sharing your personal information with third parties for certain purposes. We will consider and respond to any such requests promptly, and otherwise in accordance with applicable laws.
  • Do Not Track . Please note that our Site does not support "Do Not Track" browser settings and does not currently participate in any "Do Not Track" frameworks that would allow us to respond to signals or other mechanisms regarding the collection of your information.

6. Text Messaging

From time to time, we may ask for your consent to send you text messages, and in such case will send you text messages in accordance with that consent. In addition, we will use information that you provide to us for the purpose of sending you text messages in accordance with this Privacy Policy.

7. Children

We do not knowingly or purposefully request or collect personal information from any person under the age of 13 years old. If you believe that your child under the age of 13 has submitted personal information to Xylocats in connection with our Site, please contact us at [email protected].

8. Security

We take steps to help protect the confidentiality and security of your personal information. Although we use measures to protect your personal information, in general, information transmitted through the Internet may not be completely secure. Accordingly, we cannot guarantee the security of information provided over the Internet or stored in our databases. Your transmissions are, therefore, at your own risk.

9. Retention

We only retain personal information for as long as reasonably necessary for the purpose in which it was collected. For example, where your personal information is needed to provide you with access to our Site, we retain such information for the period in which we are providing you access unless we are required by law to dispose of it earlier or to keep it longer. We also retain personal information as necessary to comply with our legal obligations, resolve disputes, pursue legitimate business interests, conduct audits, and protect or enforce our rights.

This Site may, from time to time, contain links to websites owned and operated by third parties ("Third-Party Sites"). We encourage you to review the privacy policies of such Third-Party Sites so that you understand how those websites collect, use, and share your information. We are not responsible for the privacy policies or other content on Third-Party Sites.

Likewise, this Privacy Policy does not cover the privacy practices of social media platforms on which Xylocats may have social media pages. Please review the terms, policies, and settings of those social media platforms if you have questions about how they collect and use your data.

13. Privacy Rights of EEA and UK Residents

Although Xylocats is based in the United States, we may, from time to time, process "personal data" of people who reside in the European Union, Iceland, Liechtenstein, Norway, or the United Kingdom, which processing may be subject to the European Union’s General Data Protection Regulation (also called the "GDPR") or the United Kingdom General Data Protection Regulation (also called the "UK-GDPR"). "Personal data" is defined in the GDPR and the UK-GDPR as "any information related to an identified or identifiable natural person," and, for purposes of this Privacy Policy, references to "personal data" in this section include the categories of information set forth in section 1 above, if applicable.

We will only process your personal data to the extent applicable law allows us to do so.

The United States has not sought nor received a finding of "adequacy" from the European Union or the United Kingdom under article 45 of the GDPR or article 45 of the UK-GDPR.
